Program Commitment: We take a great deal of time and energy to make your our members are a good fit for the HCCC, and that we can help you. By clicking the terms and conditions you agree to stay in the club for at least six months.
MEMBER COMMITMENT
If you are in this program, it is highly unlikely that we will ever need to address anything that even comes close to this, but as a company we want you to be clear on where we stand. We are committed to building an anti-racist business and do not tolerate hate speech, racism, bigotry, sexism or bullying of any kind. If we see or hear this happening, we will approach you directly to clarify intent. After which we reserve the right to remove you from the program and revoke access to all program materials without refund. By agreeing to the terms and conditions, we are both acknowledging that we have read, understand, agree to, and accept all of the terms in this Agreement. Electronic check-box & signatures are sufficient and enforceable. Your Program will not begin until the Terms have been agreed upon and payment has been received.
IN THE UNLIKELY EVENT OF A DISPUTE (Non-Disparagement)
In the event of a dispute between us, we agree to resolve the dispute amicably. If the dispute cannot be resolved privately, we agree to submit the matter to mediation. During the mediation process, of course, you are not prohibited from sharing your thoughts and opinions as a part of the legal process.
We put energy, intention, and care into everything from program delivery to our marketing so that what you are offered and promised is what we deliver (actually, we deliver even MORE than what our marketing portrays! Still finding the words for the personal transformation that happens inside the club while also respecting the privacy of our members!) So when you join there should be no need for refunds. So we have a no refund policy.
That being said if you have joined at least two lives calls and opened the course material and you're not happy, you can schedule a 1:1 with Carly within the first 14 days to discuss why the program wasn't what you expected. not happy with the program.
AUTOMATIC BILLING: If you have chosen the payment plan you will be automatically billed 30 days from your initial payment for a total of six payments.
The Heart Centered Coach Club: Program materials in the Heart Centered Coach Club are available to you as long as you are an active member. This is an intentional choice. We don't want this to be a program gathering dust. We want you to use it! And, there are plenty of opportunities to save the swipes, spreadsheets, and templates for future reference.
Commitment: We put an extraordinary amount of time, energy and effort not only into creating our training materials but ensuring each member of our community is supported. This is not just an online program, it’s a community! And we pour our heart and soul into making this community a place where everyone feels like they can show up authentically.
INTELLECTUAL PROPERTY
Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works of, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the content, recordings, methods or other materials related to this course.
RELEASE AUTHORIZATION
By enrolling in the FIRST 5 Program and/or The Heart Centered Coach Club, you hereby grant permission to Carly Clark Zimmer and her company Balance by the Bay, LLC at https://carlyclarkzimmer.com the right of your image, in video or still photograph, and of the likeness and sound of your voice as recorded on audio or video tape, and any social media posts you voluntarily share inside the Heart-Centered Coach Clun Facebook group without payment or any other consideration. You understand that your image, audio or posts may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein your likeness appears.
Additionally, you waive any rights to royalties or other compensation arising or related to the use of your image, posts or recording.
Photographic, audio or video recordings, as well as Facebook group posts may be used for ANY USE which may include but is not limited to: Presentations, Courses, Online / Internet videos, Media, News or Press, Promotions or online advertising
By purchasing the Heart Centered Coach Club, you understand this permission signifies that photographic, video, recordings, or audio recordings of you may be electronically displayed via the internet. You also understand that anything you post inside Facebook Community may be distributed for promotional purposes on the internet by Carly Clark Zimmer and Balance by the Bay, LLC.
There is no limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.
This release applies to photographic, audio, or video recordings collected as part of the FIRST 5 & The Heart Centered Coach Club Programs hosted by Carly Clark Zimmer and her parent company, Balance by the Bay, LLC. It also applies to any images or content you voluntarily share in the Heart-Centered Coach Club Facebook group.
You acknowledge that you have completely read and fully understand the above release and agree to be bound thereby. By purchasing this course, you hereby release any and all claims against any person or organization utilizing this material for educational or promotional purposes.
